Terms of Service

1. The Service

Pouc is currently provided as an invite-only alpha. It is offered on an “as is” basis and may change, break, or be unavailable at times. We may add, modify, or remove features at any time.

2. Eligibility & accounts

• You must be at least 16 years old to use the Service.
• You sign in with Google or Discord. New accounts are placed on a waitlist and gain access only after we approve them; access and usage limits are at our discretion and may be changed or revoked.
• You are responsible for activity under your account and for keeping your sign-in method secure.

3. Acceptable use

You agree not to:

• Use the Service to create, upload, or distribute unlawful content, or content that infringes others’ intellectual property, privacy, or other rights.
• Generate sexual content involving minors, content that promotes violence or hate, or other content prohibited by our model providers’ policies.
• Upload content you do not have the rights to use.
• Attempt to bypass approval, quotas, rate limits, or security measures; overload, probe, or disrupt the Service; or reverse-engineer it except where permitted by law.
• Resell or provide the Service to third parties without our permission.

We may suspend or terminate accounts that violate these rules.

4. Your content

You retain ownership of the prompts, files, and images you upload (“Input”) and you represent that you have the rights to use them. You grant us a limited licence to host, process, and transmit your Input and generated output (“Output”) as necessary to operate and provide the Service, including sending them to the AI providers that fulfil your requests.

5. AI-generated output

• As between you and us, you are free to use the Output you generate, subject to these Terms and to the terms of the underlying model providers.
• AI output can be inaccurate, may not be unique, and may resemble content produced for other users or existing works. You are responsible for reviewing Output and for how you use it.
• Your use of model providers through Pouc is also subject to their terms, including Google (Gemini API) and Replicate.

6. Bring-your-own keys

If you supply your own provider API keys, you are responsible for your use of those providers and any charges they incur. See our Privacy Policy for how keys are handled.

7. Fees

The Service is currently free during the alpha, subject to usage limits. We may introduce fees or change limits in the future; we will give reasonable notice before any charges apply to you.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the maximum extent permitted by law, Pouc by SABOTAGE Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of your Input, your Output, or your breach of these Terms or applicable law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access at our discretion, including for violation of these Terms. Provisions that by their nature should survive termination will survive.

12. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of Israel, without regard to its conflict-of-laws rules, and the competent courts of Israel will have exclusive jurisdiction, except where mandatory local law provides otherwise.
